Court says cities can prohibit pot shops

 


Even as the City of Goldendale may be poised to allow the opening of a marijuana shop just off Highway 97, a major court case was concluded last week that reaffirms the right of Washington municipalities to prohibit such shops.

The Washington Attorney General’s Office (AGO) Friday presented arguments in MMH, LLC v. Fife in Pierce County Superior Court before Judge Culpepper. Solicitor General Noah Purcell gave oral arguments on behalf of the AGO. Culpepper ruled following the hearing that nothing in Initiative 502 overrides local governments’ preexisting authority to regulate local businesses, including marijuana businesses, through zoning or otherwise.
