Child crime case is thrown out


There will be no retrial for Dana Reuel Klein II, who was to go on trial for rape of a child, following a Superior Court decision by Judge Brian Altman on July 21 that dismissed the case with prejudice. The ruling means Klein can never again be tried for the crime.

The Klein case was one of three cases in Klickitat County that were overturned due to a State Supreme Court decision that ruled against a common practice of allowing potential jurors to be questioned outside public court.

From Facebook page comments it seems a clarification is required -- Judge Altman made it very clear that the evidence error was made shortly after trial in 2006, years before Lori Hoctor took office in 2011. By that time, the defendant had already successfully sued the county. Judge Altman was also clear that Ms. Hoctor's administration was not, in any way, at fault.
