NOTICE TO DEFENDANT: READ THESE PAPERS CAREFULLY!

A lawsuit has been started against you in the above-entitled Court by MADISON REVOLVING TRUST 2017, Plaintiff. Plaintiff's claim is stated in the written Complaint, a copy of which is on file at the Klickitat County Courthouse. You must “appear” in this case or the other side will win automatically. To “appear” you must file with the court a legal paper called a “motion” or “answer.” The “motion” or “answer” must be given to the court clerk or administrator within 30 days along with the required filing fee. It must be in proper form and have proof of service on the plaintiff’s attorney or, if the plaintiff does not have an attorney, proof of service on the plaintiff.

The object of the complaint is to foreclose a deed of trust dated June 10, 2005 and recorded as Instrument No. 1054481 given by Kenneth L. Akins and Cynthia Akins, Husband and Wife on property commonly known as 461 Horseshoe Bend Road, Goldendale, WA 98620 and legally described as:

That portion of the Southeast quarter of Section 27, Township 4 North, Range 15 East, of the Willamette Meridian, in the County of Klickitat and State of Washington, described as follows:

Beginning at the Southeast corner of said Section 27; thence North 30 feet to the North boundary of the County Road No. 2214; thence West along said North boundary a distance of 1,322.12 feet to the true point of beginning; thence North 0 degrees 14' 11" West a distance of 1,050 feet; thence North 89 degrees 58' 18" East a distance of 605 feet; thence South 0 degrees 14' 11" East a distance of 1,050 feet to the North boundary of the County Road No. 2214; thence West along said North boundary a distance of 605 feet to the true point of beginning.

The complaint seeks to foreclose and terminate all interest of Unknown Heirs and Devisees of Loren Davenport and all other interests in the property.

The “motion” or “answer” (or “reply”) must be given to the court clerk or administrator within 30 days of the date of first publication specified herein along with the required filing fee. The date of first publication of the summons is May 6, 2019.

WHEREAS, the Board of County Commissioners has received petitions to vacate certain roads that may be of no further value to Klickitat County described as follows:

GERBING ROAD:

Beginning at its intersection with Bill Moore Road, County Road Number 14120 near the South line of Section 4, Township 4 North, Range 12 East W.M. thence in a Northerly direction for approximately 2.14 miles ending at the Corner Section between Sections 28, 29, 32 and 33, Township 5 North, Range 12 East W.M. This road was established as George Gerbing Road on October 4, 1906 in Volume 6, Page 7 of the Commissioners Journal.

BAKER ROAD:

Beginning at the intersection with Appleton Road, County Road Number 13160 in Section 34, Township 4 North, Range 12 East W.M. thence in a Northwesterly direction for approximately 1.4 miles ending at the intersection of Sleepy Hollow Road, County Road Number 14100 near the North section line of Section 28, Township 4 North, Range 12 East W.M. This road was established as George Gerbing Road on October 4, 1906 in Volume 6, Page 7 of the Commissioners Journal.

THEREFORE, BE IT RESOLVED that the County Engineer is directed to make an examination of said right of way and file his report as to whether said right of way should be vacated, whether the public will benefit by the vacation of said right of way and any other facts, matters and things which will be of importance to the Board.

FURTHER, BE IT RESOLVED, that a public hearing for said vacation of described right of way will be held in the Commissioners’ Chambers in the Klickitat County Courthouse, Goldendale, Washington on the 28th day of May, 2019 at the hour of 1:30 p.m. at which time any objections against or approval for said proposed vacation will be heard and the Board of Commissioners hereby orders that due legal notice of said hearing be given as prescribed by statute.

NOTICE OF APPLICATION TO ENTER Yakima ADJUDICATION COURT CLAIM NO. 00366 INTO THE STATE TRUST WATER RIGHT PROGRAM UNDER APPLICATION NO. CS4-00366sb9@2

TAKE NOTICE: That on February 9, 2018, under Application No. CS4-00366sb9@2, the Washington State Department of Transportation (WSDOT) applied to permanently transfer Yakima Adjudication Court Claim No. 00366 into the State Trust Water Right Program and change the place of use and purpose of use to instream flow and mitigation.

That said Court Claim No. 00366 authorizes the diversion of 1.75 cfs, 350 ac-ft/yr from Wilson Creek at a point 840 feet south and 800 feet west from the center of Section 2, being within the NE¼SW¼ of Section 2, T. 17 N., R. 18 E.W.M. That said water right is authorized for the purpose of stock water and irrigating 35 acres from April 1 through October 31 located within that part of the SW¼NE¼ and the N½SE¼ of Section 11, T. 17 N., R. 18 E.W.M., lying southwest of the right of way of the Burlington Northern Railroad.

The Primary Reach begins at the historical point of diversion on Wilson Creek and ends at a point on Wilson Creek approximately 810 feet south and 760 feet east of the center of Section 11, being within the NW¼SE¼ of Section 11, T. 17 N., R. 18 E.W.M. in the County of Kittitas, Washington.

The Secondary Reach begins at the end of the Primary Reach and continues past the confluence of Wilson Creek and the Yakima River at Yakima River Mile 115.9, continues past the confluence of the Yakima River and the Columbia River and ends at a point located at the confluence of the Columbia River and the Pacific Ocean in Section 18, T. 9 N., R. 11 W.W.M., Pacific County, Washington. The proposed instream water right will begin at Yakima River Mile 115.9 and continue to the Pacific Ocean.

Protests or objections to approval of this application must include a detailed statement of the basis for objections. All letters of protest will become public record. NOTICE OF STATE'S INTENT TO NEGOTIATE LEASE

Department of Natural Resources will begin negotiation of expiring leases with existing lessees on the following parcels. All leases are subject to third party bids by interested parties. Burn Ban

The burn ban for all areas protected by Klickitat County Rural 7 Fire and Rescue will go into effect midnight, May 31, 2019 by Resolution 20190508 of the Board of Fire commissioners. The Resolution was signed on May 8, 2019. The ban prohibits all outdoor burning. All burn permits that have been issued will be suspended during the ban until the burn season resumes in the fall.
